Here are a few interesting legal facts about it:
👉🏼 A notice of termination is only effective if it was given in writing. It must therefore be printed out and signed by hand.
👉🏼 Conversely, this means: If termination is given verbally or by email, the notice of termination is generally ineffective and therefore does not need to be withdrawn.
👉🏼 In the case of termination, it may also depend on the respective grounds for termination, social justification, or compliance with the notice period.
👉🏼 A notice of termination does not have to be accepted by the other party. So if you do not agree to the termination, it is not invalid for that reason.
👉🏼 However, if a notice of termination is withdrawn, the other party’s consent is crucial. A withdrawal of termination is therefore not possible unilaterally; it must always be intended by both parties.
👉🏼 If the contracting parties agree that the termination is to be withdrawn, this is, from a legal perspective, a new contract. From a practical perspective, however, the existing employment relationship continues (if nothing new has been agreed).
👉🏼 If you do not accept the new contractual offer (i.e., the withdrawal of the termination), the employment relationship ends as intended after the notice period expires.
