More and more digitally working people are longing for a change of scenery in their home office. When you can no longer stand your own four walls, the desire for a vacation quickly arises.
The possibility of combining work with vacation now has a name: workation. However, there are several things to consider. Therefore, I will answer the most frequently asked questions on this topic:
Am I allowed to work from abroad if I am employed in a home office?
In short: No. The fact that you are allowed to work digitally and location-independently from home does not automatically mean that the company does not care where you work. Rather, the company trusts that you will stay at home – after all, you are only insured there.
Therefore, you should discuss your plans in advance in any case and plan carefully.
How can I plan a workation as legally secure as possible?
First, you must obtain permission from your employer. You can prepare for this by informing yourself about time differences and about entry and working conditions in your destination country. Within the EU, however, this should not be a problem.
If you can ensure that you can work properly there, you provide your employer with security. This also includes agreeing on specific time windows during which you must be available or participate in meetings.
In addition, you should not spend more than 183 days abroad and retain your German residence so that you do not become subject to taxation there. However, there may be tax implications for your employer if you conclude contracts on their behalf from abroad in the course of your work.
What should I consider when planning my trip?
First, ask yourself whether you would like to stay in a hotel or in private accommodation. In any case, you should have reception and a good internet connection to carry out your work. In many cities, there are coworking spaces where you can work undisturbed.
You can also obtain additional coverage with private travel insurance. However, please note that you must bear any travel costs yourself.
